Advocate Praises Passage of Bill to Protect the Voice of Small Business in EPA Regulatory Process

Stops EPA Grab of Ditches, Ponds and other State Waters

Washington, D.C.: Karen Kerrigan, President of the Center for Regulatory Solutions, a project of the Small Business and Entrepreneurship Council, issued the following statement today after the U.S. House, by a bipartisan vote of 262 to 152, approved HR 5078, the “Waters of the United States Regulatory Overreach Protection Act”:

“The Environmental Protection Agency (EPA) is doing more than overreaching as it moves forward with its intrusive proposed rule to regulate water bodies. It has shut out the voice of America’s small business owners and entrepreneurs who will be profoundly impacted by the agency’s water grab.  H.R. 5078 is needed to rein in EPA’s extreme action and restore the collaborative relationship that state governments and the federal government have shared under the Clean Water Act (CWA). 

“Ditches and other temporary bodies of water could fall under federal control with the EPA’s new definition of U.S. waters. There’s also the catch‐all ‘other waters’ that would be subject to regulation whenever the EPA sees fit. To ignore or dismiss the rule’s impact, as EPA has, on small business owners, landowners, farmers and ordinary homeowners is downright offensive.  EPA should follow the CWA as Congress intended.”
