SBE Council Statement: Executive Memorandum on China and IP

Washington, D.C. – Today, President Donald J. Trump signed an Executive Memorandum directing the United States Trade Representative (USTR) to  consider whether to investigate China’s laws, policies, or actions that may be harming or undermining American intellectual property (IP), innovation or technology.  In response to this action, Small Business & Entrepreneurship Council (SBE Council) president & CEO Karen Kerrigan said:

“Entrepreneurs and small businesses have consistently expressed challenges protecting their IP in China.  Small firms in particular have little or no leverage when it comes to forced technology transfer or other actions where IP is compromised or stolen. The investigation is an opportunity to explore the facts and determine successful approaches going forward so that commerce between our two countries is strong, market-based and fair. We are hopeful leaders in our nation and in China will constructively work to resolve these critical issues as U.S.-China commerce is very important to overall growth and opportunity.”

SBE Council chief economist Raymond J. Keating added:

“Let’s be clear, China has long fallen short in terms of establishing and protecting intellectual property rights. In fact, it’s still troubling not just for U.S. entrepreneurs and small businesses doing business in China, but it is a grave issue for Chinese firms and the overall China economy. China’s long-run economic growth and development  – like many other nations – depends on moving to a full market economy and establishing sound protections for intellectual property.”
