SBE Council’s Kerrigan Responds to Kavanaugh Nomination to U.S. Supreme Court

Washington, D.C. –  President Donald J. Trump has nominated Brett M. Kavanaugh to succeed Justice Anthony Kennedy on the United States Supreme Court.  Small Business & Entrepreneurship Council (SBE Council) president & CEO Karen Kerrigan issued the following statement in response to Judge Kavanaugh’s nomination:

“Judge Kavanaugh said his job is to interpret the law as written and not make law, or policy. His legal opinions and decisions back up those words. Judge Kavanaugh’s judicial philosophy is especially critical for a Supreme Court justice as the U.S. Constitution guarantees and protects rights and freedoms that have kept our nation free and have made America the most entrepreneurially and innovative in the world.  Sometimes, unfortunately, the executive and legislative branches overreach when it comes to policy or legislative actions. With regard to regulation, this especially hurts small businesses as they are disproportionately burdened by excessive government rules and mandates.  Judge Kavanaugh’s opinions have recognized the limits that the constitution and law place on the federal administrative state, and this is the type of judicial philosophy that will help sustain liberty and economic freedom.  Judge Kavanaugh is an impressive, mainstream selection that all members of the U.S. Senate should get behind and support.”
