S. 233: “Working Families Flexibility Act of 2015”

Dear Senator Lee:

On behalf of the Small Business & Entrepreneurship Council (SBE Council) and its 100,000 members nationwide, I write in strong support of S. 233, the “Working Families Flexibility Act of 2015.” This important bill will give America’s workers and entrepreneurs the flexibility they need to be more effective parents, family members, employees and business owners.

When it comes to employees being compensated for working overtime, our laws allow for little flexibility. While state and local government employees have been allowed to take paid time off as compensation for working overtime, private-sector workers are provided no such option.

S. 233 would give the same flexible option to workers in the private sector. Such flexibility offers a powerful tool for employees to better manage their work, private and family time – an increasing challenge in today’s society.

The legislation allows employers the option of offering workers the choice for comp time off for overtime hours worked, or maintaining their cash wages option.  Other protections in the legislation ensure that the agreement is voluntary, that employees are able to reconsider the comp time choice and be compensated in wages accordingly, and that no changes are made to the work week and how overtime is defined.

On the employer side, this would be a big plus for small businesses and startups in terms of being able to better meet the compensation and flexibility needs of workers, and therefore becomes an effective tool for retaining and better competing for high-value employees.
