Kerrigan in Morning Consult: Outdated TCPA a Barrier to Small-Business Growth and Success

In an August 10 Op-ed in Morning Consult, SBE Council President & CEO Karen Kerrigan reviews the Telephone Consumer Protection Act of 1991 and why it needs to be modernized to end abusive lawsuits against small businesses while helping firms better communicate with customers via their preferred methods.  She said FCC action is needed to make these fixes while advancing effective strategies for dealing with illegal robocalls. As she writes in the piece:

“Let’s be clear, illegal robocalls are a big problem. Regulations need to effectively target the activity and deal with the abuse. But the law needs to draw a clear distinction between the actions of bad guys and the legitimate calls and texts sent by companies that are communicating in good faith with their customers. Effective TCPA reform would make that distinction by fixing the vague and outdated framework that is fueling lawsuits and bleeding big settlements from innocent businesses.”

Kerrigan notes that the Federal Communications Commission (FCC) is beginning to take steps, as they have embarked on a fact-finding effort that will help them inform policymaking.
