Statement on President Biden’s Vaccine and Testing Mandate for Business

Washington, D.C. – In response to President Joe Biden’s COVID-19 Action Plan, Small Business & Entrepreneurship Council (SBE Council) president & CEO Karen Kerrigan issued the following statement:

“President Biden calls his plan a ‘path out of the pandemic’ but this mandate on business is a path to confusion, vastly higher costs, new liabilities, and general workplace chaos for businesses. The restrictive one-size-fits all requirement will hamstring the flexibility business owners need  – and are using – to adapt to the ever-changing nature of the pandemic and its variants. The last thing American businesses need right now is a punitive, poorly thought-out government mandate. This vaccine and testing mandate will generate a big mess, and I urge President Biden to rethink this ill-advised step.”

According to the White House, “the Department of Labor’s Occupational Safety and Health Administration (OSHA) is developing a rule that will require all employers with 100 or more employees to ensure their workforce is fully vaccinated or require any workers who remain unvaccinated to produce a negative test result on at least a weekly basis before coming to work. OSHA will issue an Emergency Temporary Standard (ETS) to implement this requirement.”

There are reports that fines as high as $14,000 per violation will accompany the emergency rule.

Kerrigan added:

“I am staunchly pro-vax, but staunchly anti-mandate in this regard. President Biden needs to get more innovative and bring business leaders to the table for their ideas. Instead, he will bring more businesses to their knees with this punitive and job-killing approach.”
