Advocate for Entrepreneurs and Small Biz Joins Opposition to DOL Wage and Hour Administrator Nominee

Washington, D.C. – Today, the U.S. Senate Committee on Health, Education, Labor and Pensions (HELP) will hold a markup where various Biden Administration nominations will be considered, including David Weil for the Administrator of the Wage and Hour Division of the Department of Labor (DOL). The Small Business & Entrepreneurship Council (SBE Council) joined a coalition of business organizations to express strong opposition to the nomination, and SBE Council president & CEO Karen Kerrigan issued the following statement about pending committee action:

“Mr. Weil has a well-documented bias against small employers, which is both extreme and unfitting for the modern entrepreneurial era. The policies and regulations he’s written about and supported – and advanced as a former Administrator during the Obama Administration – would restrict the freedom and ability of individuals to start businesses and operate businesses that contract with other businesses or that utilize independent contractors. At a time when small businesses are still struggling in the COVID economy and need as much flexibility as possible to tap into diverse models to pivot and survive, the very policies Mr. Weil favors would harm these businesses.

“Moreover, at a time when individuals are increasingly striking out on their own to start new businesses or to supplement their income through self-employment, the policies he supports would throw cold water on that entrepreneurial activity. Our economy and local economies desperately need these new businesses. If confirmed, Mr. Weil’s tenure at the DOL’s Wage and Hour Division would be a massive blow for the revived entrepreneurial spirit in America, and we urge committee members to oppose his nomination.”
