SBE Council Voices Strong Support for Senator Ernst’s “Prove It Act”

The Federal Regulatory Blitz Harming Startups and Small Business Must End

Washington, D.C. – With federal regulatory activity proceeding at a crushing pace under President Biden, the Small Business & Entrepreneurship Council (SBE Council) is relieved that various members of Congress are stepping up to provide common-sense solutions to bring real-world views and impact to the regulatory process as these regulations are being pursued and drawn up. While the U.S. House is stepping up its oversight of federal agencies, Senator Joni Ernst (R-Iowa), Ranking Member of the Senate Committee on Small Business and Entrepreneurship, has proposed a sensible approach that will compel regulatory accountability and rationality. Today, SBE Council officially endorsed the “Prove It Act,” legislation introduced by Senator Ernst that provides meaningful reforms while boosting the small business voice during the regulatory process.

“Inflationary pressures and economic uncertainty continue to hammer small businesses, but federal regulators are tone-deaf to their challenges and pain points. New regulations continue to be proposed and enacted at a record clip. These are significant rules that will impose massive costs on small businesses while disrupting various ecosystems and models that put many startups and small businesses at risk. Senator Ernst’s ‘Prove It Act’ is not only timely, but critical to the future of entrepreneurship and small business in this country,” said SBE Council president & CEO Karen Kerrigan.

As summarized by Kerrigan in a letter to Senator Ernst in support of the bill:

“The Prove It Act forces federal agencies to show that they are complying with existing laws meant to protect small businesses, and requires an analysis of both the direct and indirect costs of these rules. Moreover, small business would be provided meaningful input regarding the effect of proposed rules. Their voice and views are critical when it comes to regulatory policy, which is another key reason why SBE Council strongly supports this vital legislative initiative.”

As noted by Kerrigan, with over $400 billion in regulatory proposals already on the books during the Biden Administration, small businesses cannot afford this regulatory insanity.

“At just two agencies alone – the Department of Labor and Federal Trade Commission – regulatory proposals are being pursued that could upend the startup ecosystem and various business-launch models, which serve as the basis for healthy entrepreneurial activity, opportunity, and small business growth. These two agencies, among others, are not listening to small businesses, and not conducting the analysis and due diligence to measure the costs and consequences of their regulatory proposals. This regulatory blitz and insanity must end, and the ‘Prove It Act’ will be one tool to bring accountability and common sense to the regulatory process. We applaud Senator Ernst’s leadership and her unrelenting championing of policies that support entrepreneurs and small businesses,” added Kerrigan.
