Why Entrepreneurs Need the “Protecting Local Business Opportunity Act”

The “Protecting Local Business Opportunity Act” introduced in the Senate and House – S. 2015 and H.R. 3459 –  is legislation that provides a simple definition of “joint employer” in the National Labor Relations Act (NLRA). This will guarantee small business owners and entrepreneurs that your livelihood and that of your employees will not be threatened by the recent National Labor Relations Board (NLRB) decision in Browning-Ferris.

UPDATE (10/28/2015): On Wednesday, October 28 the U.S. House Education and the Workforce Committee passed H.R. 3459.  Please continue to contact your House member to encourage their support of H.R. 3459 as the legislation will go to the full floor in the near future.

Every Small Business Could Be Impacted

The NLRB decision will upend your business independence, and destroy the successful franchising model.  See how here.

FACT: The new “joint employer” standard based on “indirect control” could be applied to nearly any conceivable business relationship. All small and large businesses could be negatively impacted. The NLRB’s amorphous “indirect control” joint employer standard – based on a new and novel “economic realities” test – means almost any economic or contractual relationship could trigger a finding of joint employer status. The impact would be unprecedented and massive, again, affecting all businesses – large and small.
