Coalition Letter Urging DOL to Rescind Biden-Era Independent Contractor Rule

SBE Council joined the Independent Work Coalition and 27 allied organizations in a letter to DOL Secretary Lori Chavez-DeRemer and other DOL officials requesting that the Wage and Hour Division (WHD) rescind the independent contractor rule finalized by the Biden Administration, “Employee or Independent Contractor Classification Under the Fair Labor Standards Act.”

As noted in the letter:

“The 2024 rule is currently in effect and faces litigation in several federal court cases. We appreciate that the Department has acknowledged in recent court filings that it intends to reconsider the 2024 rule, including whether to issue a notice of proposed rulemaking rescinding the regulation. We also appreciate the Department’s recent guidance that it will not rely on the 2024 regulation while it considers whether to rescind it.”
